Terms of Service
These Terms of
Service (“Terms”) govern your access to
and use of the services and PostaHope’s websites (the
“Services”), and any information, text,
graphics, or other materials uploaded, downloaded or appearing on the
Services (collectively referred to as “Content”).
Your access to and use of the Services is conditioned on your
acceptance of and compliance with these Terms. By accessing or using
the Services you agree to be bound by these Terms.
PostaHope is not
responsible for Hopes, comments, Content, and messages posted by
users of the Services. Each user of the Services is responsible for
the Hopes, comments, Content, and messages posted by them. PostaHope
shall not be liable to anyone for any action of any type, kind or
nature that arises from any users Hopes, comments, Content, and
messages. Further, PostaHope is not responsible or liable for any
action good or bad that arises from or out of a Hope being posted on
the website. Additionally, by posting a Hope on the website
PostaHope is in no way guaranteeing, warranting, pledging, promising,
assuring or otherwise saying in any way that whatever is posted in
the Hope will occur or not occur. The website is simply a forum for
users to post their Hopes and other users can comment, or otherwise
participate in whatever way said users may choose with each Hope that
is posted and whatever actions that are taken by the poster of the
Hope, or any user of the site, is in no way a reflection of
PostaHope, it’s values, thoughts, or intentions for any Hope or
comment that is posted on the website.
Basic
Terms
You are responsible
for your use of the Services, for any content you post to the
Services, and for any consequences thereof. The Content you submit,
post, or display will be viewable by everyone in the world, by users
of the Services and through third party services and websites. You
should only provide Content that you are comfortable sharing with
others under these Terms.
What you say on
PostaHope may be viewed all around the world instantly. You are what
you say, post in a Hope, comment or post as a message on PostaHope.
You may use the
Services only if you can form a binding contract with PostaHope and
are not a person barred from receiving Services under the laws of the
United States or other applicable jurisdiction. You may use the
Services only in compliance with these Terms and all applicable
local, state, national, and international laws, rules and
regulations.
The Services that
PostaHope provides are always evolving and the form and nature of the
Services that PostaHope provides may change from time to time without
prior notice to you. In addition, PostaHope may stop (permanently or
temporarily) providing the Services (or any features within the
Services) to you or to users generally and may not be able to provide
you with prior notice. PostaHope also retains the right to create
limits on use and storage at our sole discretion at any time without
prior notice to you.
The Services may
include advertisements, which may be targeted to the Content or
information on the Services, queries made through the Services,
cookies on your computer, or other information. The types and extent
of advertising by PostaHope on the Services are subject to change. In
consideration for PostaHope granting you access to and use of the
Services, you agree that PostaHope and its third party providers and
partners may place such advertising on the Services or in connection
with the display of Content or information from the Services whether
submitted by you or others.
Privacy
Any information that
you provide to PostaHope is subject to our Privacy Policy, which
governs our collection and use of your information. You understand
that through your use of the Services you consent to the collection
and use (as set forth in the Privacy Policy) of this information,
including the transfer of this information to the United States
and/or other countries for storage, processing and use by PostaHope.
As part of providing you the Services, we may need to provide you
with certain communications, such as service announcements and
administrative messages. These communications are considered part of
the Services and your PostaHope account, which you may not be able to
opt-out from receiving.
You can opt-out of
most communications from PostaHope including our newsletter, new
follower emails, etc. Please respond to the communications where it
says to and you will be removed from future communications.
Passwords
You are responsible
for safeguarding the password that you use to access the Services and
for any activities or actions under your password. We encourage you
to use “strong” passwords (passwords that use a
combination of upper and lower case letters, numbers and symbols)
with your account. PostaHope cannot and will not be liable for any
loss or damage arising from your failure to comply with the above
requirements.
Content
on the Services
All Content, whether
publicly posted or privately transmitted, is the sole responsibility
of the person who originated such Content. We may not monitor or
control the Content posted via the Services and, we cannot take
responsibility for such Content. Any use or reliance on any Content
or materials posted via the Services or obtained by you through the
Services is at your own risk. Any and all Content is subject to the
Communications Decency Act of 1996, as amended.
We do not endorse,
support, represent or guarantee the completeness, truthfulness,
accuracy, or reliability of any Content or communications posted via
the Services or endorse any opinions expressed via the Services. You
understand that by using the Services, you may be exposed to Content
that might be offensive, harmful, inaccurate or otherwise
inappropriate, or in some cases, postings that have been mislabeled
or are otherwise deceptive. Under no circumstances will PostaHope be
liable in any way for any Content, including, but not limited to, any
errors or omissions in any Content, or any loss or damage of any kind
incurred as a result of the use of any Content posted, emailed,
transmitted or otherwise made available via the Services or broadcast
elsewhere.
Your
Rights
You retain your
rights to any Content you submit, post or display on or through the
Services. By submitting, posting or displaying Content on or through
the Services, you grant us a worldwide, non-exclusive, royalty-free
license (with the right to sublicense) to use, copy, reproduce,
process, adapt, modify, publish, transmit, display and distribute
such Content in any and all media or distribution methods (now known
or later developed).
This license is you
authorizing us to make your Hopes, comments or messages available to
the rest of the world and to let others do the same. But what’s
yours is yours – you own your Content.
You agree that this
license includes the right for PostaHope to make such Content
available to other companies, organizations or individuals who
partner with PostaHope for the syndication, broadcast, distribution
or publication of such Content on other media and services, subject
to our terms and conditions for such Content use.
PostaHope has an
evolving set of rules for how interface and API developers can
interact with your content. These rules exist to enable an open
ecosystem with your rights in mind.
Such additional uses
by PostaHope, or other companies, organizations or individuals who
partner with PostaHope, may be made with no compensation paid to you
with respect to the Content that you submit, post, transmit or
otherwise make available through the Services.
We may modify or
adapt your Content in order to transmit, display or distribute it
over computer networks and in various media and/or make changes to
your Content as are necessary to conform and adapt that Content to
any requirements or limitations of any networks, devices, services or
media.
You are responsible
for your use of the Services, for any Content you provide, and for
any consequences thereof, including the use of your Content by other
users and our third party partners. You understand that your Content
may be rebroadcasted by our partners and if you do not have the right
to submit Content for such use, it may subject you to liability.
PostaHope will not be responsible or liable for any use of your
Content by PostaHope in accordance with these Terms. You represent
and warrant that you have all the rights, power and authority
necessary to grant the rights granted herein to any Content that you
submit.
PostaHope gives you
a personal, worldwide, royalty-free, non-assignable and non-exclusive
license to use the software that is provided to you by PostaHope as
part of the Services. This license is for the sole purpose of
enabling you to use and enjoy the benefit of the Services as provided
by PostaHope, in the manner permitted by these Terms.
PostaHope
Rights
All right, title,
and interest in and to the Services (excluding Content provided by
users) are and will remain the exclusive property of PostaHope and
its licensors. The Services are protected by copyright, trademark,
and other laws of both the United States and foreign countries.
Nothing in the Terms gives you a right to use the PostaHope name or
any of the PostaHope trademarks, service mark, logos, domain names,
and other distinctive brand features. Any feedback, comments, or
suggestions you may provide regarding PostaHope, or the Services is
entirely voluntary and we will be free to use such feedback, comments
or suggestions as we see fit and without any obligation to you.
Restrictions
on Content and Use of the Services
We reserve the right
at all times (but will not have an obligation) to remove or refuse to
distribute any Content on the Services and to terminate users or
reclaim usernames. Please review the PostaHope Rules (which are part
of these Terms) to better understand what is prohibited on the
Service. We also reserve the right to access, read, preserve, and
disclose any information as we reasonably believe is necessary to (i)
satisfy any applicable law, regulation, legal process or governmental
request, (ii) enforce the Terms, including investigation of potential
violations hereof, (iii) detect, prevent, or otherwise address fraud,
security or technical issues, (iv) respond to user support requests,
or (v) protect the rights, property or safety of PostaHope, its users
and the public.
PostaHope does not
disclose personally identifying information to third parties except
in accordance with our Privacy Policy.
Except as permitted
through the Services (or these Terms), you have to use the PostaHope
interface and API if you want to reproduce,
modify, create derivative works, distribute, transfer, publicly
display, publicly perform, transmit, or otherwise use the Content or
Services.
You may not do any
of the following while accessing or using the Services: (i) access,
tamper with, or use non-public areas of the Services, PostaHope’s
computer systems, or the technical delivery systems of PostaHope’s
providers; (ii) probe, scan, or test the vulnerability of any system
or network or breach or circumvent any security or authentication
measures; (iii) access or search or attempt to access or search the
Services by any means (automated or otherwise) other than through our
currently available, published interfaces that are provided by
PostaHope (and only pursuant to those terms and conditions), unless
you have been specifically allowed to do so in a separate agreement
with PostaHope (NOTE: use of and searching for rich snippets, micro
data, schema and crawling the Services is permissible; however,
scraping the Services is not permissible without the prior written
consent of PostaHope); (iv) forge any TCP/IP packet header or any
part of the header information in any email or posting, or in any way
use the Services to send altered, deceptive or false
source-identifying information; (v) interfere with, or disrupt, (or
attempt to do so), the access of any user, host or network,
including, without limitation, sending a virus, overloading,
flooding, spamming, mail-bombing the Services, or by scripting the
creation of Content in such a manner as to interfere with or create
an undue burden on the Services; or (vi) post or make public in any
way the last names of any individuals, addresses of individuals or
any other identifying information.
Copyright
Policy
PostaHope respects
the intellectual property rights of others and expects users of the
Services to do the same. We will respond to notices of alleged
copyright infringement that comply with applicable law and are
properly provided to us. If you believe that your Content has been
copied in a way that constitutes copyright infringement, please
provide us with the following information: (i) a physical or
electronic signature of the copyright owner or a person authorized to
act on their behalf; (ii) identification of the copyrighted work
claimed to have been infringed; (iii) identification of the material
that is claimed to be infringing or to be the subject of infringing
activity and that is to be removed or access to which is to be
disabled, and information reasonably sufficient to permit us to
locate the material; (iv) your contact information, including your
address, telephone number, and an email address; (v) a statement by
you that you have a good faith belief that use of the material in the
manner complained of is not authorized by the copyright owner, its
agent, or the law; and (vi) a statement that the information in the
notification is accurate, and, under penalty of perjury, that you are
authorized to act on behalf of the copyright owner.
We reserve the right
to remove Content alleged to be infringing without prior notice and
at our sole discretion. In appropriate circumstances, PostaHope will
also terminate a user’s account if the user is determined to be
a repeat infringer. Our designated copyright agent for notice of

The
Services are Available “AS-IS”
Your access to and
use of the Services or any Content is at your own risk. You
understand and agree that the Services is provided to you on an “AS
IS” and “AS AVAILABLE” basis. Without limiting the
foregoing, POSTAHOPE AND ITS PARTNERS DISCLAIM ANY WARRANTIES,
EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, OR NON-INFRINGEMENT. We make no warranty and disclaim all
responsibility and liability for the completeness, accuracy,
availability, timeliness, security or reliability of the Services or
any content thereon. PostaHope will not be responsible or liable for
any harm to your computer system, loss of data, or other harm that
results from your access to or use of the Services, or any Content.
You also agree that PostaHope has no responsibility or liability for
the deletion of, or the failure to store or to transmit, any Content
and other communications maintained by the Services. We make no
warranty that the Services will meet your requirements or be
available on an uninterrupted, secure, or error-free basis. No advice
or information, whether oral or written, obtained from PostaHope or
through the Services, will create any warranty not expressly made
herein.
Links
The Services may
contain links to third-party websites or resources. You acknowledge
and agree that we are not responsible or liable for: (i) the
availability or accuracy of such websites or resources; or (ii) the
content, products, or services on or available from such websites or
resources. Links to such websites or resources do not imply any
endorsement by PostaHope of such websites or resources or the
content, products, or services available from such websites or
resources. You acknowledge sole responsibility for and assume all
risk arising from your use of any such websites or resources and must
comply with their privacy policy, terms of service and/or rules.
Limitation
of Liability
TO THE MAXIMUM
EXTENT PERMITTED BY APPLICABLE LAW, POSTAHOPE AND ITS SUBSIDIARIES,
AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, MEMBERS, PARTNERS AND
LICENSORS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL,
SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES FOR ANY REASON OF ANY
TYPE, KIND OR NATURE, INCLUDING WITHOUT LIMITATION BUT NOT LIMITED
TO, LOSS OF PROFITS, DATA, USE, GOOD-WILL, OR OTHER TANGILE OR
INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR
INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT
OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY
DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD
PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; AND (iv)
UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR
CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING
NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT POSTAHOPE HAS
BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY
SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
FURTHER , TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW,
POSTAHOPE AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES,
AGENTS, MEMBERS, PARTNERS AND LICENSORS WILL NOT BE LIABLE FOR ANY
DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE
DAMAGES FOR ANY REASON OF ANY TYPE, KIND OR NATURE, INCLUDING WITHOUT
LIMITATION BUT NOT LIMITED TO, VICARIOUS LIABILITY, BODILY INJURY,
CONTINGENT BODILY INJURY, EMOTIONAL DISTRESS, DATA BREACH, OR ANY
OTHER TORT, CONTRACT, QUASI CONTRACT, OR OTHER LIABILITY, DAMAGE, OR
INJURY OF ANY TYPE, KIND OR NATURE. ADDITIONALLY, NO HEIR,
SUCCESSOR, ASSIGN, BENEFICIARY, ADMINISTRATOR, EXECUTOR, AGENT OR
OTHER PERSON OR ENTITY SHALL BE PERMITTED TO PURSUE ANY ACTION, SUIT,
ARBITRATION, OR PROCEEDING ON BEHALF OF ANYONE ELSE AGAINST POSTAHOPE
AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS,
MEMBERS, PARTNERS AND LICENSORS .
Exclusions
Some jurisdictions
do not allow the exclusion of certain warranties or the exclusion or
limitation of liability for consequential or incidental damages, so
the limitations above may not apply to you.
Waiver
and Severability
The failure of
PostaHope to enforce any right or provision of these Terms will not
be deemed a waiver of such right or provision. In the event that any
provision of these Terms is held to be invalid or unenforceable, the
remaining provisions of these Terms will remain in full force and
effect.
Controlling
Law; Jurisdiction; and Arbitration
THIS
CONTAINS A BINDING ARBITRATION PROVISION WHICH AFFECTS YOUR LEGAL
RIGHTS AND WILL BE ENFORCED.
Any
controversy, claim, suit or action arising out of or related to any
Hope, comment, image, or anything whatsoever related to PostaHope, or
any agent, employee, member, manager, partner, successor, or assign
of PostaHope, shall be settled by arbitration administered by the
American Arbitration Association in accordance with its Commercial
Arbitration Rules, and judgment on the award rendered by the
arbitrator may be entered in any court having jurisdiction thereof.
Any suit, action, claim, or controversy shall be governed by the laws
of the State of West Virginia. All arbitration proceedings shall be
held in Harrison County, West Virginia, at a location inside of
Harrison County, West Virginia, that is agreeable to both parties;
and you consent to the jurisdiction of and venue in such arbitration
and waive any objection as to inconvenient forum. Consistent with
the expedited nature of arbitration, each party will, upon the
written request of the other party, promptly provide the other with
copies of documents relevant to the issues raised by any claim or
counterclaim on which the producing party may rely in support of or
in opposition to any claim or defense. Any dispute regarding
discovery, or the relevance or scope thereof, shall be determined by
the arbitrator, which determination shall be conclusive. All
discovery shall be completed within 180 days following the
appointment of the arbitrator. The arbitrators will have no authority
to award punitive or other damages not measured by the prevailing
party’s actual damages, except as may be required by statute.
The arbitrator shall not award consequential damages in any
arbitration initiated, unless required by statute. Each party shall
bear its own costs and expenses and an equal share of the
arbitrators’ and administrative fees of arbitration. Except as
may be required by law, neither a party nor an arbitrator may
disclose the existence, content, or results of any arbitration
hereunder without the prior written consent of both parties. If the
parties cannot agree on an arbitrator, then each party shall select
an arbitrator of their choosing, and the two arbitrators selected
shall select a third arbitrator, and said third arbitrator shall be
the arbitrator who hears the matter and determines the arbitration
award, if any.
Entire
Agreement
These Terms, the
PostaHope Rules and our Privacy Policy are the entire and exclusive
agreement between PostaHope and you regarding the Services (excluding
any services for which you have a separate agreement with PostaHope
that is explicitly in addition or in place of these Terms), and these
Terms supersede and replace any prior agreements between PostaHope
and you regarding the Services. Other than members of the group of
companies of which PostaHope is the parent, no other person or
company will be third party beneficiaries to the Terms.
We may revise these
Terms from time to time; the most current version will always be at
PostaHope.com/legal-terms.php. If the revision, in our sole
discretion, is material we will notify you via an @PostaHope update
or e-mail to the email associated with your account, or by a message
that will appear when you sign in. By continuing to access or use the
Services after those revisions become effective, you agree to be
bound by the revised Terms.

The PostaHope
Rules
Our goal is to
provide a service that allows you to discover and receive content
from sources that interest you as well as to share your content with
others. We respect the ownership of the content that users share and
each user is responsible for the content he or she provides. Because
of these principles, we do not actively monitor user’s content
and will not censor user content, except in limited circumstances
described below.
Content
Boundaries and Use of PostaHope
In order to provide
the PostaHope service and the ability to communicate and stay
connected with others, there are some limitations on the type of
content that can be published with PostaHope. These limitations
comply with legal requirements and make PostaHope a better experience
for all. We may need to change these rules from time to time and
reserve the right to do so. Please check back here to see the latest.
Impersonation:
You may not impersonate others through the PostaHope service in a
manner that does or is intended to mislead, confuse, or deceive
others.
Trademark:
We reserve the right to reclaim user names on behalf of businesses
or individuals that hold legal claim or trademark on those user
names. Accounts using business names and/or logos to mislead others
will be permanently suspended.
Privacy:
You may not publish or post other people's private and confidential
information, such as credit card numbers, street address or Social
Security/National Identity numbers, last names, email addresses, or
any other information that would permit others to ascertain the
actual identity of that person without their express authorization
and permission.
Violence and
Threats:
You may not publish or post direct or indirect, specific threats of
violence against others, or any other Content that would be illegal
in the jurisdiction in which you are located, or in West Virginia,
or in the United States.
Copyright:
We will respond to clear and complete notices of alleged copyright
infringement. Our copyright procedures are set forth in the Terms of
Service.
Unlawful Use:
You may not use our service for any unlawful purposes or for
promotion of illegal activities. International users agree to comply
with all local laws regarding online conduct and acceptable content.
Libel and/or
Slander:
You may not publish or post direct or indirect, specific or
unspecific libelous and/or slanderous Content against others, or any
other Content that would be illegal in the jurisdiction in which you
are located, or in West Virginia, or in the United States.
Spam and Abuse
PostaHope strives to
protect its users from spam and abuse. Technical abuse and user abuse
is not tolerated on PostaHope.com, and will result in permanent
suspension. Any accounts engaging in the activities specified below
are subject to permanent suspension.
Serial Accounts:
You may not create serial accounts for disruptive or abusive
purposes, or with overlapping use cases. Mass account creation may
result in suspension of all related accounts. Please note that any
violation of the PostaHope Rules is cause for permanent suspension
of all accounts.
Username
Squatting:
You may not engage in username squatting. Accounts that are inactive
for more than 6 months may also be removed without further notice.
Some of the factors that we take into account when determining what
conduct is considered to be username squatting are:
the number of
accounts created
creating accounts
for the purpose of preventing others from using those account names
creating accounts
for the purpose of selling those accounts
using feeds of
third-party content to update and maintain accounts under the names
of those third parties
Selling user
names: Unless
you have been specifically permitted to do so in a separate
agreement with PostaHope, you agree that you will not reproduce,
duplicate, copy, sell, trade or resell the Services for any purpose,
where "Services" is defined as follows: Your use of
PostaHope’s products, services and web sites (referred to
collectively as the “Services” in this document and
excluding any services provided to you by PostaHope under a separate
written agreement) is subject to the terms of a legal agreement
between you and PostaHope.
Malware/Phishing:
You may not publish or link to malicious content intended to damage
or disrupt another user’s browser or computer or to compromise
a user’s privacy.
Spam:
You may not use the PostaHope service for the purpose of spamming
anyone. What constitutes “spamming” will evolve as we
respond to new tricks and tactics by spammers. Some of the factors
that we take into account when determining what conduct is
considered to be spamming are:
If your updates
consist mainly of links, and not personal updates;
If you post
misleading links;
The number of spam
complaints that have been filed against you;
If you post
duplicate content over multiple accounts or multiple duplicate
updates on one account;
If you post
multiple unrelated updates to a topic using #;
If you post
multiple unrelated updates to a trending or popular topic;
If you send large
numbers of duplicate @replies or mentions;
If you send large
numbers of unsolicited @replies or mentions in an attempt to spam a
service or link;
If you add a large
number of unrelated users to lists in an attempt to spam a service
or link;
If you repeatedly
post other users' Content as your own;
If you have
attempted to "sell" followers, particularly through
tactics considered aggressive following or follower churn;
Creating or
purchasing accounts in order to gain followers;
Using or promoting
third-party sites that claim to get you more followers (such as
follower trains, sites promising "more followers fast,"
or any other site that offers to automatically add followers to
your account);
If you create
false or misleading Points of Interest;
If you create
Points of Interest to name squat or spam.
Pornography:
You may not use obscene or pornographic images in either your
profile picture or user background, or in any video. The video
upload from YouTube option must not contain any violent or
pornographic material and further any video uploaded from YouTube
must comply with all the rules, terms and conditions of YouTube.
Your account may be
suspended for Terms of Service, Privacy Policy and/or any Rules
violations if any of the above is true. Accounts created to replace
suspended accounts will be permanently suspended.
Accounts engaging
in any of these behaviors may be investigated for abuse. Accounts
under investigation may be removed from Search for quality.
PostaHope reserves the right to immediately terminate your account
without further notice in the event that, in its judgment, you
violate these Rules, the Terms of Service or Privacy Policy.

PostaHope Privacy Policy
This Privacy Policy
describes PostaHope's policies and procedures on the collection, use
and disclosure of your information. PostaHope receives your
information through any or all various means; including but not
limited to our various web sites, APIs, interfaces, services,
third-parties and tracking software ("Services"). When
using any of our Services you consent to the collection, transfer,
manipulation, storage, disclosure and other uses of your information
as described in this Privacy Policy. Irrespective of which country
that you reside in or create information from, your information may
be used by PostaHope in the United States or any other country where
PostaHope operates.

Information Collection and Use
PostaHope collects
and uses your information to provide its’ Services and improve
them over time.
Information

PostaHope account, you provide some personal information, such as
your name, username, password, age, state of location and email
address. Some of this information, for example, your username and
avatar (photo or image selected by you, if one is elected to be
placed by you), is listed publicly on our Services, and in search
results. Some Services, such as view or search, do not require
registration.
Additional
Information: You may provide us with additional information but
it will not be made public. You may customize your account with
information of your choosing. PostaHope may use your contact
information to send you information about our Services or to market
to you. You may unsubscribe from these messages by following the
instructions contained within the messages or the instructions on our
web site. If you email us, PostaHope may keep your message, email
address and contact information to respond to your request. Providing
the additional information described in this section is entirely
optional.
Hopes, comments,
messages and other Public Information: Our Services are primarily
designed to help you share information with the world. Most of the
information you provide to PostaHope is information you are asking
PostaHope to make public. This includes not only the Hopes, comments,
and messages you post and the metadata provided with Hopes, comments,
and messages, such as when you Hopeed someone, something or some
idea, or make a comment or post a message related to a Hope, but also
the lists you create, the people you follow, and many other bits of
information. PostaHope default is to make the information you
provide public. Your public information is broadly and instantly
disseminated. Hopes may be tweeted on Twitter, posted on Facebook,
or any other forum and the use or dissemination thereof is out of the
control of PostaHope. For example, your Hopes are searchable by
many search engines and are immediately delivered via APIs and
interfaces to a wide range of users and services. You should be
careful about all information that will be made public by PostaHope,
not just your Hopes, comments and messages. You should not post last
names, or any unique and identifiable names or identifying
information. If a user does post a last name or a unique and
identifiable name, PostaHope may delete, in part or entirely, the
Hope, comments or messages associated therewith once notified of the
issue. If a last name or any unique or identifiable name is contained
in a Hope, comments or messages, please contact PostaHope at
Privacy@PostaHope.com
with the specific information contained in the Hope, the Hope
Identification Number (ex., Hope #103), comments or messages.
What you say on
PostaHope may be viewed all around the world instantly.
Location
Information: You may choose to note your location in your Hopes;
however, it is not recommended or required.
The location
information that you input into the location section of your
PostaHope profile is not viewable by the public.
Advertising on
PostaHope.
PostaHope strives to provide you with relevant and useful
advertising and we use Google Ads, as well as other third party ad
serving systems, to do so. We may use a range of information
including cookies, web beacons, IP addresses, usage data and other
non-personal information about your computer or device (such as
browser type and operating system) to provide you with relevant
advertising. While you are logged in or logged out of your PostaHope
Account, we may also show you advertising based on non-personally
identifiable information including but not limited to cookies, web
beacons, IP addresses, usage data and other non-personal information
from your computer, and information you have provided to us in your
PostaHope Account.
We use Google Ads on
PostaHope to help advertisers and publishers serve and manage ads on
this site and other Google partner websites. Advertisers may serve
ads based on interests and demographic categories associated with
non-personally identifiable online activity, such as Hopes viewed,
frequency of commenting, messages, uploading or activity on other
partner sites. Advertisers may also serve ads to you based on
previous activity on that advertiser's website or based on
non-personally identifiable information from other companies. This
non-personally identifiable information is held separately from your
PostaHope account data, or other personally identifying information
in our possession.
Other third-party ad
serving companies may display ads on PostaHope, provided they comply
with our ad
serving requirements. PostaHope does not provide any personal
information to these third-party ad servers or ad networks without
your consent. You should consult the respective privacy policies of
these third-party ad servers or ad networks for more information on
their practices and for instructions on how to opt-out of certain
practices. PostaHope's privacy policy does not apply to, and we
cannot control the activities of, such other advertisers or web
sites. Any data obtained by third-party ad servers subsequently
shared with PostaHope is maintained and dealt with by PostaHope in
accordance with this privacy policy.
Log Data: Our
servers automatically record information ("Log Data")
created by your use of the Services. Log Data may include information
such as your IP address, browser type, the referring domain, pages
visited, and search terms. Other actions, such as interactions with
advertisements, may also be included in Log Data.
Links:
PostaHope may keep track of how you interact with links in Hopes,
messages or comments across our Services including third party
clients by redirecting clicks or through other means. PostaHope does
this to help improve our Services, including advertising, and to be
able to share aggregate click statistics such as how many times a
particular link was clicked on.
Cookies: Like
many websites, PostaHope use "cookie" technology to collect
additional website usage data and to improve our Services, but
PostaHope does not require cookies for many parts of our Services
such as searching and looking at public user profiles, Hopes,
comments or messages, or lists. A cookie is a small data file that is
transferred to your computer's hard disk. PostaHope may use both
session cookies and persistent cookies to better understand how you
interact with our Services, to monitor aggregate usage by our users
and web traffic routing on our Services, and to improve our Services.
Most Internet browsers automatically accept cookies. You can instruct

Services: PostaHope uses a variety of services hosted by third
parties to help provide our Services, such as hosting our various
blogs and wikis, and to help us understand the use of our Services,

PostaHope does not
disclose your private information except in the limited circumstances
described herein the Privacy Policy, Terms of Service, Rules or as
required by law.
Your Consent:
PostaHope may share or disclose your information without your
consent, such as when you use a third party web client to access your
PostaHope account.

Providers: PostaHope may engage certain trusted third parties to
perform functions and provide services to us. PostaHope may share
your personal information with these third parties, but only to the
extent necessary to perform these functions and provide such
services, and only pursuant to obligations mirroring the protections

Law and Harm:
PostaHope may disclose your information if PostaHope believe that it

Business

bankruptcy, merger, acquisition, reorganization or sale of assets,

as your public Hopes or the number of users who clicked on a

access or modify the personal information you provided to us and
associated with your account.
Our Policy Towards Children
Our Services are not
directed to people under 13 years old. If you become aware that your
child has provided us with personal information without your consent,

PostaHope does not knowingly collect personal information from
children under 13 years old. If PostaHope becomes aware that a child
under 13 years old has provided us with personal information,
PostaHope will take steps to remove such information and terminate
the child's account.
